Need your opinion...

More then 80% of work on this forum is in copyright violation. I am betting one nice big cold Guiness in the hot day for this statement :) If not even more.

But as @RebelAir has already pointed out, we do it as practise, we dont profit from the end product.

I agree with Rebel on this one, if i was going to paint something for profit I'd want some sort of originality to it.
 
Paul Rosher was kind enough to allow me to replicate his design and thanked me for asking his permission. Great relief for me and my conscious has relaxed. Thanks to @steveo017 for giving me the communication details and thank you all for supporting me and helped me.
He did asked me to send him the final result which I'll certainly will, so everything went pretty well!

But what about the creator of the design?
Who paul is apparently not bothering to credit and claiming it is his own.

I mean id probably be with andreza and just consider im only being paid to apply it one time and not really worry about it too much. I certainly wouldnt claim I created it though. Thats a whole other level of bad juju to me

When you informed me about copyrights and so on, I've imagined that I need to contact the creator of what the customer brought to me, which is the color version of the girl. I don't know if credits were given to John Doe for the color version he re-produced but just to know, in cases like these what's the right thing to do? I mean should I have asked permission from john doe or rosher?

IMO paul has zero rights to the image. By giving you permission hes claiming hes either the creator or has acquired the sole rights.
Paul cant give permission for that image anymore than he could give permission to paint one of his spiderman images. Only difference is that we all clearly and obviously know paul didnt create spiderman.
At least IMO pauls image doesnt even come close to changing the meaning and is clearly derivative. So clearly that i dont believe for a second that the girl could have been painted without looking directly at the john doe image/ if not projecting it.
A few minor alterations does not a new design make.

My opinion of the technicalities here. Im not claiming that I personally always take the high ground.
Just that claiming to create a design rather than have copied it is a line I dont cross.
 
You are now copying a fake and not the original, you have permission of the author of the fake so you are doing nothing wrong,
From a technical standpoint I disagree here, whether he had permission or not still gives him zero right to give others permission.
but im not lawyer.

the table is going into your friends house and Will be seen only by him and his family so don't worry about.

Besides at this point I think theyve both had whatever credit is due. Its not like your putting it in a gallery and saying its your original piece. :D:lipssealed:

It's the same as if a client asks you to paint picture of Hulk from a comic on his bike. Are you going to credit the creator of Hulk or the artist who did that rendition in that specific issue? You can paint a generic picture of a big green man but then you might end up with the Big Green Giant who is most likely also copyrighted.
 
Thamks guys for the info. You made me get the idea of what's going on in these situations. Just didn't want to do anything illegal or smg that'll put me in trouble...
